Jo Ann Palchak is an experienced litigator who represents individuals and companies in civil and criminal investigations and prosecutions, as well as in complex civil litigation.
Ms. Palchak litigates matters involving the Securities Exchange Acts of 1933 and 1934. These matters often involve allegations of breaches of fiduciary duty and disclosure obligations.
Ms. Palchak has counseled individuals and corporations in disputes arising from merger and settlement agreements and in analyzing disgorgement penalties and other equitable relief arising from allegations of securities related fraud.
Her experience in complex business disputes includes breach of contract, breach of implied duty of good faith, civil theft, breach of fiduciary duty, misappropriation of trade secrets and trademark infringement, replevin, and conversion actions, as well as injunctive relief. She has represented several high-profile clients, helping to resolve their legal challenges under intense public scrutiny. She has also conducted internal investigations for companies in industries ranging from health care to publishing. Ms. Palchak also deals with consumer harm, handling disputes with broker dealers and other matters before Finra.
Ms. Palchak also practices white collar criminal defense and has represented clients in criminal and civil enforcement cases involving allegations of financial fraud, violations of the Anti-Kickback Statute, Stark, and False Claims Act in both state and federal court.
In her significant state and federal court practice, Ms. Palchak represents clients in felony and misdemeanor proceedings. She also counsels clients seeking appellate or post-conviction relief. Ms. Palchak performs a considerable amount of pro bono in the area of criminal law. Her efforts have been recognized by various awards from the legal community.
Ms. Palchak's work with inner city youth and defense of "emerging adults" encompasses matters on and off school campuses. She is a sought after advocate on the rights of children, in general, and is often appointed by the courts as an attorney ad litem. Ms. Palchak believes every child should have a fair chance so she is regularly engaged in matters concerning due process and reasonable accommodation on behalf of children. Ms. Palchak also mentors youth and organizes activities to benefit youth.
Ms Palchak received the 2018 Florida Bar President's Pro Bono Service Award at a ceremony at the Florida Supreme Court.
